    1. Services we provide

    GroupTiv is an app produced and managed by PikaPage Limited (hereafter referred to as "PikaPage". We provide a platform via website and app for users to create groups for sharing photos and information, collecting preferences from others and messaging. The list of services is non-exclusive and additional services may be added in the future. We will perform our best to combat harmful conduct and misuse of our services. If we find out contents or conduct as mentioned, we will take appropriate actions – removing content, restraining user’s access, disabling certain features, or seeking assistance from law enforcement.

     

    2. Your help for us and the community

    In order to provide the best community to all of you, we need your help for the followings:

    • Use a name that other users could identify you in real life 
    • Not give access to your GroupTiv account to others 
    • Create only one account 
    • Not create or share any content: 
      • breaches these Terms 
      • violates any applicable law from your location 
      • infringes someone else’s right including their intellectual property  rights 

    We also need your permission on these to provide our services:

    • Permission to update software that you download or use: if you download  or use our software, you give us permission to download and install  updates to the software where available 
     

    3. Your Content

    You are exclusively responsible for your Content created or shared. You bear all risks associated with use of your Content. You hereby certify that your User Content does not violate these terms or is unlawful.

    To help support our community, we encourage you to report content or conduct that you believe violates your rights or our terms and policies. We will inform you if your content violates any of our terms or is unlawful and remove the content. For content on GroupTiv reported to us and reviewed as violating any of our terms, we will remove the corresponding content and inform the creator with the decision.

    1. No pornography
    2. No violence and harmful content
    3. No hate speech and bullying
    4. No spamming and manipulation
    5. No fraud and deceptive content
    6. No personal or sensitive information
    7. No illegal activities
    8. No impersonation
    9. No Copyright and trademark infringement
    10. No virus, malware or anything that could damage a device system or data

    We reserve the right to review any User Content, and to investigate and/or take appropriate action against you in our sole discretion if you violate the GroupTiv Content Guidelines or any other provision of these Terms or otherwise create liability for us or any other person. Such action may include removing or modifying your User Content, terminating your Account, and/or reporting you to law enforcement authorities.

     

    Third-Party Links & Ads

    On GroupTiv, users could create or share a link to third-party websites and services or display photo advertisements for third parties. These contents should also follow the GroupTiv Content Guideline. For any out-going links or advertisements which violate the GroupTiv Content Guideline or any laws and regulations, we will take appropriate action to protect other users.

     

    4. GENERAL USE OF THE SERVICE

    Content. Except for User Content (defined in Section 3), the content that we

    provided to Users on or through the Service, including, without limitation to text, graphics, photos, software and interactive features, are protected by copyright or other intellectual property rights and owned by PikaPage or its third party licensors. Moreover, PikaPage solely owns all design rights, databases and compilation and other intellectual property rights in and to the Service, in each case whether registered or unregistered, and any related goodwill.

    License. Subject to your complete and ongoing compliance with this Terms and Conditions, PikaPage hereby grants you a revocable, non-exclusive, non-transferable, non-sublicensable, royalty-free and worldwide right and license to: (i) download, install and use the App on any device that you own or control; and (ii) access and use the publicly available Service, in each case, solely for your personal use.

     

    Marks. The GroupTiv trademarks, service marks, and logos are PikaPage’s registered/unregistered trademarks. You may not use any of the trademarks without prior consent of PikaPage except permitted by law.

    Reservation of Rights. PikaPage hereby reserves all rights not expressly granted to you in this Section 4. Accordingly, nothing in these Terms and Conditions or on the Service will be construed as granting to you, by implication, estoppel or otherwise, any additional license rights in and to the Service or any GroupTiv Content or Trademarks located or displayed therein.

     

    5. Warranties and Limitation on Liability

    Warranties. PikaPage AND USERS ACCEPT, PikaPage’S SERVICES AND CONTENTS ARE PROVIDED ON A “AS IS” BASIS. PikaPage PROVIDES NO WARRANTIES AS TO THE FUNCTION OR USE OF THE SERVICES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF SERVICES AND CONTENTS IS WITH USER. PikaPage DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SERVICE WILL MEET USER'S REQUIREMENTS OR THAT THE OPERATION OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE.

     

     

    Limitation of liability. IN NO EVENT WILL ANY PikaPage PARTY BE LIABLE FOR ANY SPECIAL, INDIRECT, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION RESULTING FROM, OR IN CONNECTION WITH, THE USE OR INABILITY TO USE THE SERVICE AND ANY CONTENT THEREON, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF SUCH PikaPage PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

     

     

    JURISDICTION AND DISPUTES. These Terms shall be governed by the laws of Hong Kong. Any dispute, controversy, difference or claim arising out of or relating to this contract, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted.

     

    6. General Terms and Condition

    Modify of terms and conditions. Company may update, amend, modify or supplement the terms and conditions, including any Schedules, any SLAs, the AUP and the Privacy Policy, from time to time by giving user notice. Such changes will take effect immediately. Any such modification may be made without the consent of any third party beneficiaries. You can review the most current version of this Agreement at any time at: (http://www.pikapage.com/terms/). Your continued use of Your Account or the Services after Company posts a new version of the Agreement will be conclusively deemed to be accepted by You of any such new version.

     

    WAIVER. No waiver by either party of any default shall be deemed as a waiver of any prior or subsequent default of the same or other provisions of this Agreement.
